Uraian Informasi atau Fakta Material Pada tanggal 15 November 2023, PT Straits Mining Services
yang merupakan anak usaha Perseroan, telah menerima surat
Panggilan Sidang dari Pengadilan Negeri Jakarta Utara atas
perkara perdata yang diajukan oleh PT Maraja Masogi sebagai
Tergugat II.
Dapat kami sampaikan bahwa kedudukan hukum yang
mengikat antara PT Straits Mining Services (PT SMS) dengan
PT Maraja Masogi (PT MM) adalah perjanjian sewa menyewa
alat berat yang dimiliki oleh PT SMS kepada PT MM, dimana
hingga saat ini, PT MM masih memiliki kewajiban terhutang
kepada PT SMS, yaitu belum melakukan pembayaran biaya
sewa kepada PT SMS, sehingga dalam perkara ini,
seharusnya PT SMS menjadi pihak yang dirugikan. Oleh
sebab itu, pada proses pengajuan perkara hukum yang
diajukan oleh PT MM kepada PT SMS tersebut, dapat kami
sampaikan tidak berlandaskan hukum yang kuat. Oleh sebab
itu Direksi Perseroan, melalui Direksi anak usaha Perseroan,
akan mengajukan tindakan hukum sesuai peraturan
perundang-undangan yang berlaku untuk membela hak-hak
nya.
Dampak kejadian, informasi atau fakta Hingga saat ini, perkara hukum tersebut belum berdampak
material tersebut terhadap kegiatan terhadap kegiatan operasional, kondisi Keuangan atau
operasional, hukum, kondisi keuangan, kelangsungan usaha Anak usaha Perseroan maupun
atau kelangsungan usaha Emiten atau Perseroan.
Perusahaan Publik
Dampak hukumnya, Anak Usaha Perseoran, melalui kuasa
hukumnya, sedang mempersiapkan langkah hukum untuk
mengajukan gugatan balik atas perkara hukum tersebut.

Description of Material Information or On November 15, 2023, PT Straits Mining Services which is a
Facts subsidiary of the Company, has received a summons from the
North Jakarta District Court for a civil case filed by PT Maraja
Masogi as Defendant II.
We can say that the binding legal position between PT Straits
Mining Services (PT SMS) and PT Maraja Masogi (PT MM) is
a lease agreement for heavy equipment owned by PT SMS to
PT MM, where until now, PT MM still has outstanding
obligations to PT SMS, namely not paying the lease fee to PT
SMS, so that in this case, PT SMS should be the injured party.
Therefore, in the process of filing a legal case filed by PT MM
against PT SMS, we can say that it is not based on strong law.
Therefore, the Board of Directors of the Company, through the
Board of Directors of the Company's subsidiary, will submit
legal action in accordance with applicable laws and regulations
to defend its rights.
Impact of event, material information or Until now, the legal case has no impact on the operational
facts towards Issuers or Public activities, financial condition or business continuity of the
Company’s operational activities, legal, Company's Subsidiaries or the Company.

The legal impact is that the Company's Subsidiary, through its
attorney, is preparing legal steps to file a counter lawsuit
against the legal case.
