perkembangan terakhir, Kantor Pelayanan Kekayaan Negara dan Lelang
Jakarta | mengungkapkan bahwa Perseroan juga telah ditetapkan sebagai
penanggung hutang berdasarkan Surat Keputusan Penetapan Jumlah Piutang
Negara No. 60/PUPNC.10.01/2021 dengan jumlah piutang negara sebesar IDR
391.605.638 (tidak termasuk biaya administrasi pengurusan 1096) dan 1
dokumen lainnya yang belum teridentifikasi, dengan jumlah utang kurang lebih
sebesar: (i) USD 12.000 dan (ii) EUR 4.000 (tidak termasuk biaya administrasi
pengurusan 1096) (secara bersama-sama disebut sebagai “Tuduhan Utang”).

Perseroan telah menjelaskan dalam beberapa diskusi bahwa berdasarkan
dokumen yang tersedia, Perseroan tidak lagi memiliki utang kepada Pemerintah
sejak Pemerintah telah menjual dan mengalihkan utang tersebut kepada pihak
ketiga pada tahun 2003. Namun demikian, terlepas dari dokumen dan informasi
yang telah diberikan oleh Perseroan, Pemerintah tetap bersikeras terhadap
Tuduhan Utang tersebut tanpa menyediakan dokumen pendukung apa pun
sehubungan dengan Tuduhan Utang tersebut. Oleh karena itu, untuk
melindungi hak-hak Perseroan, Perseroan mengajukan gugatan untuk meminta
agar tindakan atau keputusan Pemerintah yang berkaitan dengan pengelolaan
data dan informasi, penanganan, dan penagihan piutang negara yang berkaitan
dengan Tuduhan Utang dinyatakan batal dan dicabut

Referring to the Company's announcement of material information or facts dated
29 March 2023 and 4 September 2023, the Company would like to further
update that on 17 November 2023, the Company filed an administrative lawsuit
lo lhe Jakarta State Administrative Court against the relevant Indonesian
Govemment agencies, namely (i) Director of State Assets Management of the
Ministry of Finance of the Republic of Indonesia, (ii) Directorate General of State
Assets of Ministry of Finance of the Republic of Indonesia, (iii) Head of DKI
Jakarta Branch Committee for State Receivable Affairs, and (iv) Executive Head
of Task Force for Handling State Collection Rights for Bank Indonesia Liguidity
Assistance.

Referting to the communication between the Company and Task Force for
Handling State Collection Rights for Bank Indonesia Liguidity Assistance at the
| end of 2022 to early 2023, the Company found that the Company's
“management” has been designated as the debt guarantor based on Decision
Letter on Debt Amount Stipulation No. PJPN-26/PUPNC.10.01/2021 with the
amount of state receivables are: (i) USD 187,229.98, (ii) EUR 50,464,794.57,
and fiii) IDR 13,956,331,037.50 (excluding 104 of management fee). Further,
recentiy, ihe State Assets and Auction Service Office of Jakarta I revealed that
the Company is also designated as the debt guarantor based on Decision Letter
on Debt Amount Stipulation No. 60/PUPNC.10.01/2021 with the amount of state
receivables is IDR 391,605,638 (excluding 1045 management fee) and one other
document, which has not yet identified, with the amount approximately: (i) USD
12.000, and (ii) EUR 4.000 (excluding 1096 management fee) (collectively
referred to as “Alleged Debt).

The Company has explained in various discussions that according to the
available documents, the Company no longer holds any debt to the Govemment
Since the Govemment has sold and transferred the debt to a third party in 2003.
However, regardless of documents and information provided by the Company,
the Govemment still insists on the Alleged Debt without providing any supporting
documents of such Alleged Debt. Accordingly, to protect the Company's rights,
the Company filed a lawsuit to reguest that the Govemments actions or
decisions relating management of data and information, handling and collection
of state receivables relating to the Alleged Debt be declared null and void and
revoked. |
