PKPU Ends, New Round of Acceleration of Totalindo's Performance Recovery
Jakarta, August 16, 2023- On Tuesday, August 15, 2023, a panel of judges of the Commercial Court ratified the
peace agreement between the debtor PT Totalindo Eka Persada Tbk ("Totalindo") and the creditor at the
Central Jakarta District Court.
Previously, voting was held on August 9, 2023 at the Commercial Court at the Central Jakarta District Court,
attended by 100% of separatist creditors with 100% approval of the total bill value amount IDR 974M.
Concurrent creditors present at the voting were 274 creditors out of a total of 315 concurrent creditors with
95.7% affirmative votes or as many as 259 affirmative votes from 274 concurrent creditors present with a total
bill value of IDR 459M.
The peace plan was approved by the majority of creditors and based on a court ruling changed its status to a
Peace Agreement. The court homologated and gave a ratification ruling on the Peace Agreement. That way,
legally the postponement of debt payment obligations (PKPU) is declared complete and binds the debtor and
creditor parties.
With the approval of the PKPU peace plan by creditors, the Company will settle all debts through a number of
schemes based on the amount of debt value to creditor groups. The approved peace proposal was prepared
by considering the interests of creditors and the Company's ability to fulfill debt restructuring obligations to
creditors.
Vice President Director, Salomo Sihombing expressed his gratitude and appreciation to the creditors for the
support and trust given to the Company and we are optimistic about the approval This peace plan will be
a good momentum to spur positive and sustainable growth in the Company's business performance until the
Company is better prepared to face various challenges ahead.
"The PKPU ended with the ratification of the peace agreement in accordance with Totalindo's expectations. It
is proven that the peace proposal submitted can satisfy the parties. This means that creditors believe that the
proposal offered by Totalindo can be implemented properly. After this ruling, the obligation to pay debts to
creditors can be carried out well in the future," said Salomo Sihombing - Vice President Director of Totalindo.
The same thing was conveyed by the debtor's attorney Doddy Boy Silalahi from BOSS Law Firm, "This decision
will bind the creditors with Totalindo as the debtor. Our best efforts have been done well with this ruling. The
debt repayment plan under the new scheme will be an obligation to be carried out by Totalindo to creditors."
Meanwhile, Financial Advisor of Triple B Advisory, Noprian Fadli said he was grateful that the peace proposal
submitted by Totalindo was approved by its creditors and was optimistic that debt payment obligations could
be resolved properly after this homologation ruling.
Until now, the Company's operational activities continue to run normally and are still focused on running the
construction services business by actively participating in a number of new project tenders. The Company is
working on 15 projects out of a total contract acquisition of IDR 1,021T. In the second quarter of 2023, one of
which is the Company has completed the Ballroom Building Project or Royal Glass House MNC.
