Permohonan PKPU oleh CV. Pacific Indojaya sehubungan
dengan tagihan sebesar Rp. 1.495.194.369 kepada Perseroan
Application for Postponement of Debt Payment Obligations
(PKPU) by CV. Pacific Indojaya in relation to a claim of Rp.
1,495, 194,369 to the Company

Dampak kejadian, informasi atau
fakta material tersebut terhadap
kegiatan operasional, hukum,

usaha emiten atau perusahaan

Sehubungan dengan permohonan tersebut diatas, perlu kami
sampaikan hal-hal sebagai berikut:

1. Bahwa Permohonan PKPU yang diajukan oleh CV
Pacific Indojaya merupakan permohonan yang bersifat
vexatious litigation di mana permohonan ini diajukan

bertujuan untuk

mengganggu dan merugikan nama baik Eratex:

sekali kegiatan usaha/operasional Eratex:

3. Bahwa Eratex adalah Perusahaan yang mapan yang telah
berdiri sejak tahun 1972 dan sampai saat ini tetap
beroperasi dengan baik. Hal ini dapat dibuktikan,
sebagai berikut:

a. adanya keuntungan/laba perusahaan yang
diperoleh Eratex selama 3 (tiga) tahun berturut-
turut (Tahun Buku 2022, 2023 dan 2024)

b. total asset Eratex saat ini sebesar lebih dari 1
(satu) triliun Rupiah
(Rp. 1,344,254,313,116,-)

c. Selain itu Eratex selama ini telah melakukan
praktik usaha yang wajar,

d. memiliki jumlah karyawan yang cukup besar
yaitu 8.401 karyawan: dan

e. Eratex adalah perusahaan yang produksinya
hampir 10046 dickspor ke
sehingga — telah menghasilkan devisa bagi
Negara Republik Indonesia cukup besar (hampir
USD 100,000,000 di tahun 2024)

4. Bahwa terkait tagihan CV Pacific Indojaya (PI) kepada

Eratex sebesar Rp. 1,495,194,369,- menurut catatan
kami, tagihan ini tidak sesuai dengan ketentuan yang
berlaku,

5. Bahwa perlu kami sampaikan kejanggalan yang
dilakukan PI dalam mengajukan permohonan PKPU ini
yaitu PI didirikan pada tanggal 27 DESEMBER 2024
berdasarkan Akta No. 5 tertanggal 27 Desember 2024
yang dibuat di hadapan Carrin Finrely, SH, MKn,
Notaris di Kabupaten Kuningan, namun tagihan yang
diklaim tersebut merujuk kepada tagihan bulan Juli —
Oktober 2024 periode mana sebelum PI didirikan:

6. Selain itu dalam permohonan yang diajukan PI, PI telah
mengalihkan/menjual sebagian tagihannya — terhadap
Eratex ke seseorang yang bernama Sdr. INDRA
PRANAJA TJULAN (“INDRA”) pada tanggal 5 MEI
2025 melalui Akta Perjanjian Jual Beli (Cessie) No. 3
tanggal 5 Mei 2025 yang dibuat oleh Notaris Getri
Permata Sari, SH, MKn. Menurut hemat kami, PI
sesungguhnya secara hukum tidak memiliki tagihan
dimaksud namun tanpa alasan yang jelas kemudian
dialihkan ke Sdr. INDRA.

7. Oleh karena itu pula, kami juga mempertimbangkan
untuk mengambil langkah-langkah hukum terkait dengan
pengalihan tagihan tersebut di atas:

8. Oleh karena itu permohonan PKPU oleh PI yang
diajukan terhadap Eratex adalah permohonan yang
dibuat tanpa dasar dan tidak patut, untuk menekan
Eratex dan mengganggu jalannya usaha Eratex sebagai
suatu perusahaan padat karya yang membantu
Pemerintah Republik Indonesia untuk penyerapan tenaga
kerja, peningkatan perkonomian daerah dan juga
meningkatkan pendapatan Pemerintah — Republik
Indonesia dari sektor perpajakan.

In connection with the above reguest, we need to convey the
Jollowing:

That the PKPU Application submitted by CV Pacific
Indojaya is an application of a vexatious litigation
nature, where this application was submitted without any
legal basis, but rather aimed at disturbing and harm the
good name of Eratex,

That this PKPU application does not disrupt Eratex's
business/operational activities at all,

That Eratex is an established company that has been
established since 1972 and is still operating well to this
day. This can be proven as follows:

a. the existence of company profits/earnings obtained
by Eratex for 3 (three) consecutive years (Fiscal
Years 2022, 2023 and 2024)

b. current total assets is more than 1 (one) trillion
Rupiah (Rp. 1,344,254,313,116,- )/

c. In addition, Eratex has been conducting fair
business practices, and

d. has a fairly large number of employees, namely
8.401 employees,

e. Eratex is a company whose production is almost
10046 exported abroad, s0 it has generated guite a
lot of foreign exchange for the Republic of Indonesia
(almost USD 100,000,000 in 2024)

That regarding the bill of CV Pacific Indojaya (PI) to
Eratex amounting to Rp. 1,495,194,369,- according to
our records, this bill does not comply with the applicable
provisions,

That we need to convey the oddity committed by PI in
submitting this PKPU application, namely that PI was
established on DECEMBER 27, 2024 based on Deed
No. 5 dated December 27, 2024 made before Carrin
Finrely, SH, MKn, Notary in Kuningan Regency,
however, the claimed bill refers to the bill for July —
October 2024, which was the period before the PI was
established,

In addition, in the application submitted by PI, PI has
Iransferred/sold part of its bills against Eratex to a
person named Mr. INDRA PRANAJA  TJULAN
(“INDRA”) on MAY 5, 2025 through the Deed of Sale
and Purchase Agreement (Cessie) No. 3 dated May 5,
2025 made by Notary Getri Permata Sari, SH, MKn. In
our opinion, PI actually does not legally have the said
bill but for no clear reason it was then transferred to Mr.
INDRA.

Therefore, we are also considering taking legal steps
regarding the transfer of the above bill:

Therefore, the PKPU application by PI submited
against Eratex is an application made without basis and
is inappropriate, to pressure Eratex and disrupt the
running of Eratex's business as a labor-intensive
company that helps the Government of the Republic of
Indonesia to absorb labor, improve the regional
economy and also increase the income of the
Government of the Republic of Indonesia from the
taxation sector.
