Uraian Informasi atau Fakta Material Pada tanggal 28 November 2024 diadakan sidang dengan

sebagai berikut :
PENUNDAAN :
Menguatkan Penetapan Penundaan Pelaksanaan yang telah
ditetapkan oleh Majelis PTUN Nomor 237/G/2024/PTUN.JKT
tanggal 31 Juli 2024
EKSEPSI :
Menyatakan seluruh eksepsi yang diajukan oleh Tergugat
tidak diterima
POKOK PERKARA :
1. Mengabulkan Gugatan Penggugat untuk seluruhnya;
2. Menyatakan batal :
a.) Keputusan Tata Usaha Negara berupa Keputusan Kuasa
Pengguna Anggaran Satuan Kerja Direktorat
Jenderal Energi Baru, Terbarukan dan Konversi Energi dan
Sumber Daya Mineral Nomor : 72.K/KU.01/KPA/2024 tentang
Penetapan Sanksi Daftar Hitam tanggal 28 Mei 2024;
b.)Penayangan Sanksi Daftar Hitam pada laman
www.Inaproc.id
3. Mewajibkan dan memerintahkan Tergugat untuk :
a.) Mencabut KTUN berupa Keputusan KPA SatKer DirJen
Energi Baru, Terbarukan dan Konversi Energi dan Sumber
Daya Mineral Nomor : 72.K/KU.01/KPA/2024 tentang
Penetapan Sanksi Daftar Hitam tanggal 28 Mei 2024
4. Menghentikan penayangan (take down) PT Waskita Karya
(Persero) Tbk dari Daftar Hitam Nasional pada laman
www.Inaproc.id;Menghukum Tergugat untuk membayar biaya
perkara.
Pada tanggal 23 Desember 2024 diterbitkan Surat Pengiriman
Salinan Putusan Berkekuatan Hukum Tetap Nomor :
4207/Pbt.BHT/G/2024/PTUN.JKT oleh Pengadilan Tata Usaha
Negara kepada PT Waskita Karya (Persero) Tbk sehubungan
dengan penyampaian bahwa Putusan Pengadilan Tata Usaha
Negara Nomor : 237/G/2024/PTUN.JKT telah Berkekuatan
Hukum Tetap.
Pada tanggal 31 Desember 2024 Kementerian Energi dan
Sumber Daya Mineral Direktorat Jenderal Energi Baru
Terbarukan dan Konservasi Energi menerbitkan Keputusan
Kuasa Pengguna Anggaran Direktorat Jenderal EBTKE Nomor
122.K/KU.02/KPA/2024 tentang Pembatalan Sanksi Daftar
Hitam yang memutuskan membatalkan Surat Keputusan
Sanksi Daftar Hitam Nomor 72.K/KU.01/KPA/2024 tanggal 28
Mei 2024 tentang Penetapan Sanksi Daftar Hitam kepada PT
Waskita Karya (Persero) Tbk.
Dampak kejadian, informasi atau fakta Dengan adanya keputusan sebagaimana dimaksud, memiliki
material tersebut terhadap kegiatan dampak positif yang sangat signifikan terhadap kegiatan
operasional, hukum, kondisi keuangan, operasional dan kondisi keuangan PT Waskita Karya (Persero)
atau kelangsungan usaha Emiten atau Tbk.

Description of Material Information or On November 28, 2024, a hearing was held with the agenda of
Facts reading the Administrative Court Decision with case number
237/G/2024/PTUN.JKT dated November 20, 2024, via e-court
with the following decision:
SUSPENSION:
Affirming the Suspension Order previously issued by the
Administrative Court Panel No. 237/G/2024/PTUN.JKT dated
July 31, 2024.
EXCEPTION:
Declaring all exceptions raised by the Defendant as
inadmissible.
SUBSTANTIVE MATTER:
1. Granting the Plaintiff's lawsuit in its entirety;
2. Annuling:
a.) The Administrative Decision issued by the Budget User
Authority of the Directorate General of New, Renewable
Energy and Energy Conservation, and Mineral Resources, No.
72.K/KU.01/KPA/2024 regarding the Blacklist Sanction dated
May 28, 2024;
b) The publication of the Blacklist Sanction on the website
www.Inaproc.id.
3. Ordering and instructing the Defendant to:
a.) Revoke the Administrative Decision in the form of the
Budget User Authority Decision of the Directorate General of
New, Renewable Energy and Energy Conservation, and
Mineral Resources No. 72.K/KU.01/KPA/2024 regarding the
Blacklist Sanction dated May 28, 2024.
4. Terminating the publication (take down) of PT Waskita
Karya (Persero) Tbk from the National Blacklist on the website
www.Inaproc.id; and ordering the Defendant to pay the
litigation costs.
On December 23, 2024, the Administrative Court issued the
Delivery of the Final and Binding Decision Copy No.
4207/Pbt.BHT/G/2024/PTUN.JKT to PT Waskita Karya
(Persero) Tbk, notifying that the Administrative Court Decision
No. 237/G/2024/PTUN.JKT has become final and binding.
On December 31, 2024, the Ministry of Energy and Mineral
Resources, Directorate General of New, Renewable Energy
and Energy Conservation issued the Budget User Authority
Decision of the Directorate General of EBTKE No.
122.K/KU.02/KPA/2024 regarding the Cancellation of the
Blacklist Sanction, which annulled the Blacklist Sanction
Decision No. 72.K/KU.01/KPA/2024 dated May 28, 2024,
regarding the imposition of the Blacklist Sanction on PT
Waskita Karya (Persero) Tbk.
