Uraian Informasi atau Fakta Material Pada tanggal 18 November 2024, Emiten mendapat informasi
dari informasi dari Kuasa Hukum (Corporate Lawyer) bahwa
terdapat pengajuan Permohonan Penundandaan Kewajiban
Utang di Pengadilan Negeri Medan yang diajukan oleh:
1. Pemohon PKPU-1 atas nama Labora Simbolon;
2. Pemohon PKPU-1 an. Irmawani Aritonang;
Didalam Permohonan PKPU, terdapat Kreditur lain dengan
pihak sebagai berikut:
1. Kreditur Lain 1 an. Nuri Zulita Br Surbakti
2. Kreditur Lain 2 an. Ditawarni Sidabutar
Bahwa para Pemohon PKPU dan Kreditur Lain sebelumnya
merupakan karyawan pada Emiten. Pada tahun 2020 terjadi
perselisihan hubungan kerja (perselisihan industrial) di
Pengadilan Hubungan Industrial pada Pengadilan Negeri
Medan. Terhadap perselisihan tersebut telah ada Putusan final
dan Emiten dihukum untuk membayar pesangon sebagai
berikut:
1. Pemohon PKPU atas nama Labora Simbolon,
sebesar Rp. 40.335.686,- sesuai dengan putusan Pengadilan
Hubungan Industrial pada Pengadilan Negeri Medan Reg. No.
: 210/Pdt.Sus-PHI/2020/PN.Mdn tanggal 28 September 2020
Jo. Putusan Mahkamah Agung RI Reg. No. : 427 K/Pdt.Sus-
PHI/2023 tanggal 12 April 2023.
2. Pemohon PKPU an. Irmawani Aritonang sebesar Rp.
61.180.000,- sesuai dengan putusan Pengadilan Hubungan
Industrial pada Pengadilan Negeri Medan Reg. No. : 188/Pdt.
Sus-PHI/2020/PN.Mdn tanggal 3 Maret 2021 Jo. Putusan
Mahkamah Agung RI Reg. No. : 1043 K/Pdt.Sus-PHI/2022
tanggal 19 Juni 2022
3. Kreditur Lain 1 an. Nuri Zulita Br Surbakti sebesar Rp.
61.180.000,- sesuai dengan putusan Pengadilan Hubungan

4. Kreditur Lain 2 an. Ditawarni Sidabutar sebesar Rp.
30.697.644,- sesuai dengan putusan Pengadilan Hubungan

Putusan Mahkamah Agung Rl Reg. No. : 1450 K/Pdt.Sus-
PHI/2022 tanggal 18 Oktober 2022.
Bahwa terhadap seluruh Putusan Hubungan Industrial yang
telah final, Emiten telah beritikad baik untuk melakukan
pembayaran namun Para Pemohon PKPU menolak
pembayaran. Salah satu komunikasi oleh Emiten pada tanggal
16 Agustus 2023 mengirimkan surat kepada Kuasa Hukum
Para Pemohon PKPU untuk melakukan pembayaran namun
tidak ada respon.
Bahwa Para Pemohon PKPU juga pernah mengajukan
Permohonan Eksekusi atas Putusan-Putusan tersebut. pada
proses permohonan eksekusi tersebut justru Para Pemohon
PKPU yang tidak menindaklanjuti sehingga (berdasarkan
informasi yang kami lihat pada website Pengadilan Negeri

Medan) register permohonan eksekusi telah dihapus oleh
Pengadilan Negeri Medan, yang berarti tidak ditindaklanjuti
oleh Para Pemohon PKPU.
Bahwa meskipun Emiten telah berkomunikasi dengan baik
dengan Kuasa Hukum Para Pemohon Eksekusi namun tidak
pernah ada respon yang baik dan justru saat ini Para
Pemohon PKPU mengajukan PKPU.
Untuk menghadapi persidangan PKPU, Emiten telah
menyiapkan cek untuk melakukan pembayaran dan cek telah
diberikan kepada Kuasa Hukum Emiten untuk disampaikan
pada persidangan. Dengan cek tersebut diharapkan Pemohon
PKPU mencabut permohonan PKPU nya atau Putusan
Pengadilan nantinya menolak Permohonan PKPU dengan
pertimbangan bahwa Emiten masih beritikad baik dan mampu
untuk melakukan pembayaran secara full.
Dampak kejadian, informasi atau fakta Emiten yakin bahwa emiten mampu menyelesaikan pesangon
material tersebut terhadap kegiatan Para Pemohon PKPU dengan kondisi keuangan Emiten yang
operasional, hukum, kondisi keuangan, cukup baik serta Emiten selama ini telah beritikad baik untuk
atau kelangsungan usaha Emiten atau melakukan pembayaran. Selain itu Emiten telah menyiapkan
Perusahaan Publik cek atas nama Para Pemohon PKPU serta Kreditur Lain.
Apabila Majelis Hakim mengabulkan Permohonan PKPU,
Emiten akan kembali menyampaikan cek yang telah
diterbitkan pada agenda rapat kreditur, sehingga hutang
dapat terselesaikan .
Adanya Permohonan PKPU ini tidak mempengaruhi
kelangsungan usaha Emiten.

Description of Material Information or On November 18, 2024, the Issuer received information from
Facts the Legal Counsel (Corporate Lawyer) that there was a
submission of a Request for Suspension of Debt Obligations at
the Medan District Court filed by:
1. PKPU-1 Applicant on behalf of Labora Simbolon;
2. PKPU-1 Applicant on behalf of Irmawani Aritonang;
In the PKPU Application, there are other Creditors with the
following parties:
1. Other Creditor 1 on behalf of Nuri Zulita Br Surbakti
2. Other Creditor 2 on behalf of Ditawarni Sidabutar
That the PKPU Applicants and Other Creditors were previously
employees of the Issuer. In 2020 there was an employment
dispute (industrial dispute) at the Industrial Relations Court at
the Medan District Court. Regarding the dispute, there has
been a final decision and the Issuer has been sentenced to
pay severance pay as follows:
1. PKPU applicant on behalf of Labora Simbolon, amounting to
Rp. 40,335,686,- in accordance with the decision of the
Industrial Relations Court at the Medan District Court Reg. No.:
210/Pdt.Sus-PHI/2020/PN.Mdn dated September 28, 2020 Jo.
Decision of the Supreme Court of the Republic of Indonesia
Reg. No.: 427 K/Pdt.Sus-PHI/2023 dated April 12, 2023.
2. PKPU applicant on behalf of Irmawani Aritonang amounting
to Rp. 61,180,000,- in accordance with the decision of the
Industrial Relations Court at the Medan District Court Reg. No.:
188/Pdt.Sus-PHI/2020/PN.Mdn dated March 3, 2021 Jo.
Decision of the Supreme Court of the Republic of Indonesia
Reg. No. : 1043 K/Pdt.Sus-PHI/2022 dated June 19, 2022
3. Other Creditors 1 in the name of Nuri Zulita Br Surbakti in
the amount of Rp. 61,180,000,- in accordance with the
decision of the Industrial Relations Court at the Medan District
Court Reg. No. : 189/Pdt.Sus-PHI/2020/PN.Mdn dated March
3, 2021 Jo. Decision of the Supreme Court of the Republic of
Indonesia Reg. No. : 1050 K/Pdt.Sus-PHI/2022 dated June 19,
2022.
4. Other Creditors 2 in the name of Ditawarni Sidabutar in the
amount of Rp. 30,697,644,- in accordance with the decision of
the Industrial Relations Court at the Medan District Court Reg.
No. : 272/Pdt.Sus-PHI/2020/PN.Mdn dated 21 December 2020
Jo. Supreme Court Decision Rl Reg. No. : 1450 K/Pdt.Sus-
PHI/2022 dated 18 October 2022.
That for all final Industrial Relations Decisions, the Issuer has
acted in good faith to make payments, but the PKPU
Applicants have refused payment. One of the communications
by the Issuer on August 16, 2023, sent a letter to the Legal
Counsel of the PKPU Applicants to make payments, but there
was no response. That the PKPU Applicants have also filed an
Execution Application for the Decisions. In the execution
application process, the PKPU Applicants did not follow up so
that (based on the information we saw on the Medan District
Court website) the execution application register has been
deleted by the Medan District Court, which means that it was

not followed up by the PKPU Applicants. That even though the
Issuer has communicated well with the Legal Counsel of the
Execution Applicants, there has never been a good response
and in fact the PKPU Applicants are currently filing a PKPU.
To face the PKPU trial, the Issuer has prepared a check to
make the payment and the check has been given to the
Issuer's Legal Counsel to be submitted at the trial. With this
check, it is hoped that the PKPU Applicant will withdraw his/her
PKPU application or the Court Decision will later reject the
PKPU Application on the grounds that the Issuer still has good
intentions and is able to make full payment.
Impact of event, material information or The Issuer is confident that the Issuer is able to complete the
facts towards Issuers or Public severance pay of the PKPU Applicants by considering the
Company’s operational activities, legal, Issuer's financial condition which is quite good and the Issuer
financial condition, or going concern has so far acted in good faith to make payments. In addition,
the Issuer has prepared checks in the name of the PKPU
Applicants and Other Creditors.
If the Panel of Judges grants the PKPU Application, the Issuer
will resubmit the checks that have been issued on the creditor
meeting agenda, so that the debt can be settled.
The existence of this PKPU Application does not affect the
continuity of the Issuer's business.
