Referring to the Company's Disclosure of Information
No. 070/PLOG-Dir/VI/2024 dated June 10, 2024, we
hereby inform that on September 27, 2024, the
Company received a copy of the Arbitration Award
("Award") from the Indonesian National Board of
Arbitration ("BANI") regarding the civil case ("Case")
related to the Coal Transshipment Agreement from
Barge to Vessel dated September 1, 2022
("Agreement"), in which the Company acted as the
PlaintifffRespondent in the Counterclaim against PT
Sentosa Laju Energy ("SLE") as the Respondent/Plaintiff
in the Counterclaim.
3 Description
In the Award, essentially, the Arbitration Tribunal ruled
as follows:
1. Declares the Agreement valid and binding
among the Parties,
2. Declares that this arbitration Award is final and
binding among the Parties:

Declares that SLE has breached the Agreement in relation to the failure on vessel scheduling after March 7, 2023 up to the termination of the Agreement, 4. Declares that SLE has breached the Agreement in relation to the failure to fulfill payment obligations under the Agreement in the amounts of Rp1,326,358,269.60 and Rp357,642,896.33, and therefore, SLE is obligated to pay material damages incurred by the Company amounting to Rp1,684,001,165.93, as well as moratorium interest of Rp73,081,036.89, 5.
