PT DPM menghormati putusan Mahkamah Agung. Namun demikian, PT DPM akan melakukan upaya hukum luar biasa
(seperti Peninjauan Kembali (PK) Perkara TUN di Mahkamah Agung dan upaya hukum lainnya) karena adanya bukti-
bukti yang menunjukkan bahwa: (i) masyarakat sekitar lokasi tambang PT DPM di Desa Longkotan memberi dukungan
penuh atas konstruksi tambang PT DPM dan meminta agar tambang PT DPM segera beroperasi. Hal ini bertolak
belakang dengan klaim penggugat bahwa masyarakat sekitar lokasi tambang PT DPM menolak kegiatan operasi PT
DPM. Dalam hal ini penggugat adalah 4 warga Desa Bongkaras, 6 warga Desa Pandiangan dan 1 warga Desa Lae
Panginuman. Desa Bongkaras termasuk dalam desa lingkar tambang PT DPM, sedangkan Desa Pandiangan dan Desa
Lae Panginuman bukan termasuk dalam desa lingkar tambang PT DPM. Penggugat dalam mengajukan gugatannya
dibantu oleh YDPK, Bakumsu, Petrasa, dan NGO asing Inclusive Development International; (ii) kajian baru atas
tambang PT DPM menyatakan bahwa fasilitas pengolahan limbah yang akan dibangun PT DPM akan menekankan
aspek ramah lingkungan. PT DPM akan mengutamakan kelestarian lingkungan dan keselamatan warga Dairi di sekitar
Lokasi tambang dalam pengoperasiannya, sesuai dengan peraturan dan perundangan yang berlaku.

Sampai dengan Keterbukaan Informasi ini, PT DPM belum menerima salinan resmi putusan MA. Secara prinsip PT
DPM akan terus melakukan upaya-upaya yang diperlukan agar dapat menjalankan proyek DPM sesuai dengan
perizinan yang dimiliki.

 Description of Material Information or       On August 14, 2024, the Company received information

                                              Case currently being faced by PT DPM. (TUN Case)
                                              Summary information regarding the TUN Case is as follows:

                                              Case Type: TUN
                                              Applicant: Marlince Sinambela, et al.
                                              Respondent: (i) Minister of Environment and Forestry of the
                                              Republic of Indonesia and (ii) PT DPM
                                              Decision Date: August 12, 2024
                                              Decision Injunction: Appealed
                                              The Supreme Court in its decision has granted the cassation
                                              request from the applicant. The object of the State
                                              Administrative Case is the Decree of the Minister of
                                              Environment and Forestry of the Republic of Indonesia No.:
                                              SK.854MENLHKSETJENPLA.482022 concerning the
                                              Environmental Feasibility of Zinc and Lead Mining Activities in
                                              Silima Pungga Pungga District, Dairi Regency, North Sumatra
                                              Province by PT Dairi Prima Mineral.

Other Information

PT DPM respects the Supreme Court's decision. However, PT DPM will take extraordinary legal measures (such as
a judicial review (PK) of the TUN case at the Supreme Court and other legal measures) because there is evidence
showing that: (i) the community around the PT DPM mining site in Longkotan Village fully supports the construction
of the PT DPM mine and requests that the PT DPM mine operate immediately. This is contrary to the plaintiff's
claim that the community around the PT DPM mining site rejects PT DPM's operational activities. In this case, the

plaintiffs are 4 residents of Bongkaras Village, 6 residents of Pandiangan Village and 1 resident of Lae Panginuman
Village. Bongkaras Village is included in the PT DPM mining ring village, while Pandiangan Village and Lae
Panginuman Village are not included in the PT DPM mining ring village. The plaintiff was assisted in filing his
lawsuit by YDPK, Bakumsu, Petrasa, and the foreign NGO Inclusive Development International; (ii) a new study of
the PT DPM mine stated that the waste processing facility to be built by PT DPM will emphasize environmentally
friendly aspects. PT DPM will prioritize environmental sustainability and the safety of Dairi residents around the
mining location in its operations, in accordance with applicable regulations and laws.

As of this Disclosure of Information, PT DPM has not received an official copy of the Supreme Court's decision. In
principle, PT DPM will continue to make the necessary efforts to be able to run the DPM project in accordance with
the permits it has.
