Uraian Informasi atau Fakta Material Pada tanggal 31 Juli 2024 Majelis Hakim yang memeriksa dan
memutus Perkara Nomor: 237/G/2024/PTUN.JKT telah
mengeluarkan Keputusan Penetapan Penundaan atas Surat
Keputusan Penetapan Sanksi Daftar Hitam yang pada intinya
sebagai berikut :
1. Mengabulkan permohonan PT Waskita Karya (Persero)
Tbk. tentang Penundaan Pelaksanaan Keputusan Tata Usaha
Negara berupa:
-Keputusan Kuasa Pengguna Anggaran Satuan Kerja
Direktorat Jenderal Energi Baru, Terbarukan dan
Konservasi Energi, Kementerian Energi dan Sumber Daya
Mineral Nomor: 72.K/KU.01/KPA/2024 tentang
Penetapan Sanksi Daftar Hitam, tanggal 28 Mei 2024;
-Penayangan Sanksi Daftar Hitam PT Waskita Karya (Persero)
Tbk dari Daftar Hitam Nasional pada
laman www.inaproc.id.
2. Memerintahkan kepada Kuasa Pengguna Anggaran Satuan
Kerja Direktorat Jenderal Energi Baru, Terbarukan dan
Konservasi Energi, Kementerian Energi dan Sumber Daya
Mineral untuk menunda Pelaksanaan Keputusan Tata Usaha
Negara yang menjadi objek sengketa berupa:
-Keputusan Kuasa Pengguna Anggaran Satuan Kerja
Direktorat Jenderal Energi Baru, Terbarukan dan
Konservasi Energi, Kementerian Energi dan Sumber Daya
Mineral Nomor : 72.K/KU.01/KPA/2024
tentang Penetapan Sanksi Daftar Hitam, tanggal 28 Mei 2024;
-Penayangan Sanksi Daftar Hitam PT Waskita Karya (Persero)
Tbk dari Daftar Hitam Nasional pada laman www.inaproc.id.
Selama proses persidangan berlangsung sampai putusan
dalam perkara Nomor: 237/G/2024/PTUN.JKT
memperoleh kekuatan hukum tetap.
Bahwa informasi ini didasari fakta yang kami terima
berdasarkan salinan putusan sidang Pengadilan Tata
Usaha Negara (PTUN) dan laporan persidangan dari Hendi
Gandasmiri Lawyers selaku kuasa hukum
Perseroan, dan status penayangan sanksi daftar hitam pada
laman www.inaproc.id akan mengikuti putusan
sidang ini.
Dampak kejadian, informasi atau fakta Dengan adanya keputusan sebagaimana dimaksud, memiliki
material tersebut terhadap kegiatan dampak positif yang sangat signifikan terhadap
operasional, hukum, kondisi keuangan, kegiatan operasional dan kondisi keuangan PT Waskita Karya
atau kelangsungan usaha Emiten atau (Persero) Tbk sehingga PT Waskita Karya (Persero) Tbk dapat
Perusahaan Publik kembali mengikuti proses tender seluruh proyek Pemerintah
yang menggunakan dana APBN atau APBD, maupun proyek-
proyek swasta.

Description of Material Information or On July 31th, 2024, the panel of judges who examined and
Facts decided on Case Number: 237/G/2024/PTUN.JKT issued a
Decision on the Postponement of the Decree on the Sanction
of Blacklisting, which essentially states as follows:
1. Granted the request of PT Waskita Karya (Persero) Tbk. for
the Postponement of the Implementation of the State
Administrative Decision in the form of:
-Decision of the Budget User Authority of the Directorate
General of New, Renewable Energy and Energy Conservation,
Ministry of Energy and Mineral Resources Number:
72.K/KU.01/KPA/2024 concerning the Imposition of
Blacklisting Sanctions, dated May 28th, 2024;
-Publishing the Blacklist Sanction of PT Waskita Karya
(Persero) Tbk from the National Blacklist on the
www.inaproc.id.
2. Command the Budget User Authority of the Directorate
General of New, Renewable Energy and Energy Conservation,
Ministry of Energy and Mineral Resources to postpone the
Implementation of the State Administrative Decision which is
the object of the dispute in the form of:
-Decision of the Budget User Authority of the Directorate
General of New, Renewable Energy and Energy Conservation,
Ministry of Energy and Mineral Resources Number:
72.K/KU.01/KPA/2024 concerning the Imposition of
Blacklisting Sanctions, dated May 28th, 2024;
-Publishing the Blacklisting Sanction of PT Waskita Karya
(Persero) Tbk from the National Blacklist on the
www.inaproc.id.
This postponement is effective during the trial process until the
decision in Case Number: 237/G/2024/PTUN.JKT has
permanent legal force.
This information is based on the facts we received from a copy
of the State Administrative Court (PTUN) decision and the trial
report from Hendi Gandasmiri Lawyers as the legal counsel for
the Company, and the status of the blacklisting sanction
display on the website www.inaproc.id will follow this court
decision.
Impact of event, material information or With the decision as referred to, it has a very significant
facts towards Issuers or Public positive impact on the operational activities and financial
Company’s operational activities, legal, condition of PT Waskita Karya (Persero) Tbk so that PT
financial condition, or going concern Waskita Karya (Persero) Tbk to once again participate in the
tender process for all Government projects funded by the State
Budget (APBN) or Regional Budget (APBD), as well as private
